Harlequins Market

Terms of Service

Last updated June 2026

Agreement

By accessing this site or placing an order on Harlequins Market you agree to these Terms of Service. If you do not agree, please do not use this site.

Who We Are

Harlequins Market is an independent Magic: The Gathering card shop operating as a node on the Free Market Protocol. It is an unincorporated business based in Kentucky, United States. We sell Magic: The Gathering singles, sealed product, prebuilt decks, and print-on-demand merchandise to customers in the United States. We also host community features, including public deck lists.

Who You Are Buying From

Everything offered on this site is sold to you by Harlequins Market as the seller of record. Where an item was sourced from a third party — for example, a card taken in on consignment — Harlequins Market remains the seller, holds the item, sets the listing, and is the party you contract with. Your order, your payment, and any return are with us.

Eligibility & Age

Orders may only be placed by someone 18 or older, because placing an order forms a contract and authorizes a payment. If you are between 13 and 18, you may browse and use the site only under the supervision of a parent or guardian, and any order must be placed by that adult on their own account. The adult agrees to these Terms and is the responsible party for the order.

We do not knowingly allow children under 13 to create an account or place an order. See our Privacy Policy for how we handle children's information.

Orders & Payment

All prices are in US dollars. Payment is processed securely by Stripe. We do not store your card details. An order is confirmed when you receive a receipt email from us.

We reserve the right to cancel any order if an item is found to be out of stock, mispriced, or unavailable. A full refund will be issued immediately in that case. We may also limit quantities, decline or cancel an order we reasonably believe to be fraudulent, and require tracked shipping on high-value orders.

Taxes

Listed prices do not include sales tax. Any applicable state and local sales tax is calculated and shown at checkout based on your shipping destination, and is collected and remitted where we are required to do so by law. You are responsible for any tax shown on your order.

Shipping

We ship to US addresses only. Orders are typically processed within 1–3 business days. Shipping estimates are provided by the carrier and are not guaranteed. Risk of loss remains with us until the order is delivered to you. Standard (untracked) shipping is offered only on lower-value orders precisely because we carry that risk; we may require tracked shipping where an account has repeated loss claims. Returns and shipping-damage claims are handled under our Refund & Return Policy.

Item Condition

Cards are graded using the Near Mint (NM), Lightly Played (LP), Moderately Played (MP), Heavily Played (HP), and Damaged (DMG) scale. We grade conservatively. Minor variations within a grade are inherent to the hobby and are not considered misrepresentation.

Authenticity

We sell genuine Wizards of the Coast product. We do not knowingly list counterfeit, proxy, or altered cards, and we inspect what we take in. If a card you bought from us is shown to be counterfeit, contact us and we will refund it in full, including shipping, and cover the return — this applies regardless of the return windows below.

Accounts & Identity

You may create an account using an email address or an Ethereum wallet. Account holders on the Free Market Protocol receive an Auth-Key — a soulbound NFT identity that persists across all protocol nodes. You are responsible for keeping your login credentials secure and for all activity under your account. We may suspend or close an account that we reasonably believe is being used fraudulently, abusively, or in breach of these Terms.

Your Auth-Key is an identity credential. It is not an investment, it is not sold to you, and it carries no cash value.

Member Rewards

We may issue member reward tokens in connection with purchases. Rewards are a loyalty benefit, not a currency or an investment: they have no cash value, cannot be redeemed for cash, are not transferable for value, and confer no ownership, profit share, or voting right in any business. We may change, pause, or end the rewards program at any time, and rewards attached to an order may be reversed if that order is refunded or charged back.

Your Content

The site lets you create content — deck lists, deck names, written primers, and similar. You keep ownership of what you write. By making it public you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and share it on and about the site for as long as you keep it published.

Do not post content that is unlawful, infringing, hateful, harassing, obscene, deceptive, or that impersonates someone else, and do not use the community features to advertise a competing storefront. We may remove content or unpublish a deck at our discretion, and we will remove content that infringes copyright on proper notice — write to us at the contact address below and identify the work and the URL.

Intellectual Property

Magic: The Gathering, its card names, mana symbols, and related imagery are copyrights and trademarks of Wizards of the Coast LLC. Harlequins Market is an independent reseller and is not affiliated with, endorsed, sponsored, or approved by Wizards of the Coast. All product images and names are used solely to identify the genuine products we sell.

The Harlequins Market name, logo, site design, and original written content are our property and may not be copied or reused without permission.

Prohibited Use

You may not use this site for any unlawful purpose, to submit false orders, or to attempt to exploit pricing errors in bad faith. We reserve the right to refuse service to anyone.

Disclaimer of Warranties

Our conservative grading reflects our honest professional assessment of each card's condition, but card grading is inherently subjective and is not a warranty. THE SITE AND OUR PRODUCTS ARE PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Nothing here limits any right you have under law that cannot be waived, and it does not affect our authenticity commitment above.

Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages.

Indemnification

You agree to hold Harlequins Market harmless from claims or expenses arising out of your misuse of the site or your violation of these Terms.

General

We are not liable for delays or failures caused by events outside our reasonable control, including carrier disruption, supplier failure, payment-processor outage, natural disaster, or loss of connectivity. We may assign these Terms to a successor if the business is incorporated, sold, or reorganised; you may not assign yours without our consent. If we do not enforce a provision, that is not a waiver of it.

You agree to receive notices from us electronically, at the email address on your account or shown at checkout, and that electronic records satisfy any requirement that a communication be in writing.

Dispute Resolution & Class-Action Waiver

Talk to us first — nearly everything is settled by email. If we cannot settle it, you and Harlequins Market agree to resolve any dispute arising from an order or from your use of this site by binding individual arbitration, administered under the rules of a recognised arbitration provider, rather than in court. Either of us may still bring an individual claim in small-claims court if it qualifies.

YOU AND HARLEQUINS MARKET AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. An arbitrator may not consolidate claims or preside over any form of class proceeding.

Nothing here waives any right that cannot be waived under law, and it does not affect our authenticity commitment or your statutory consumer rights. If the class-action waiver above is found unenforceable, this entire Dispute Resolution section does not apply and any dispute goes to the courts named below.

Governing Law

These Terms are governed by the laws of the State of Kentucky, without regard to its conflict-of-laws rules. Any dispute that is not otherwise resolved will be brought in the state or federal courts located in Hardin County, Kentucky.

Severability & Entire Agreement

If any part of these Terms is found unenforceable, the rest remains in effect. Together with our Privacy Policy and Refund & Return Policy, these Terms are the entire agreement between you and Harlequins Market regarding your use of the site.

Changes

We may update these terms from time to time. The current version will always be posted at this URL. Continued use of the site after changes constitutes acceptance.

Harlequins Market

Condition & Grading Standard

In effect July 2026

Purpose

This Standard defines what each condition grade means on Harlequins Market, so a stated grade means the same thing on every listing. Every item on this site is graded and sold by us — see Who You Are Buying From in our Terms.

The Conservative Principle

We grade conservatively. When a card sits between two grades, we list the lower one. Condition is assessed in good lighting on surface, edges, corners, and centering. Grading is a judgment call; this describes our consistent method, not a promise that every eye will agree.

Constructed & Preconstructed Decks

A deck we assemble from singles carries one grade for the whole deck, and that grade is bound by two rules so a stack of clean cards can never disguise the worst card in the box:

1. A deck is never listed higher than one grade above its lowest card. A single Moderately Played card caps the deck at Lightly Played, however good the other ninety-nine are.
2. A majority of the cards must be at the listed grade or better.

So a deck of ninety-eight Near Mint cards with two Lightly Played is listed Near Mint; the same deck with one Moderately Played card is listed Lightly Played. Deck listings state the grade and the lowest card in the deck, so you know what you are buying before you buy it.

Near Mint (NM)

Appears unplayed or nearly so. At most very minor handling — a tiny edge nick, a faint surface imperfection, or a slightly off-center cut visible only on close inspection. No creases, no noticeable whitening, no play wear. Most current singles sit here.

Lightly Played (LP)

Minor wear visible at normal viewing distance: light edge whitening, minor corner wear, a small scratch or scuff. Structurally sound, no creases that affect play.

Moderately Played (MP)

Clearly visible wear: noticeable border or edge whitening, corner wear, scratching or scuffing, light scratching to foil, or a light crease. Still tournament-playable in a sleeve.

Heavily Played (HP)

Major wear: heavy whitening, significant creasing, scuffing, surface or water marks. The card remains intact and identifiable, with no holes and no material missing.

Damaged (DMG)

Severe wear or a defect affecting structure or identity: heavy creasing, tearing, water damage, writing, bends, or material loss. Always sold explicitly as Damaged.

Mint

We do not use a Mint or Gem Mint tier on raw cards — those claims belong to professionally graded slabs. A card that might qualify is listed as Near Mint.

Foils & Special Finishes

Foils use the same tiers and are additionally assessed for foil-specific wear: clouding, scratching of the foil layer, and curling. Mild factory curl is common to foils and is not by itself a defect.

Altered, Signed & Graded Cards

Altered, signed, or artist-modified cards are always disclosed and are never sold as unaltered. Professionally graded cards in sealed slabs are listed by the grader's assigned grade and serial; the raw tiers above do not override a professional grade.

Photographs

Listings use catalog imagery to identify the card and printing, but the stated grade governs what you are promised. We include photographs of the actual item for any card graded MP or below, and for any altered or signed card.

Sealed Product

Sealed product is described by factory-seal state and packaging condition, not by the card tiers. We do not sell resealed product. Anything whose seal is broken is listed as opened, with contents described.

If We Get It Wrong

If a card arrives materially worse than its listed grade, or is the wrong card or printing, our Refund & Return Policy governs the remedy. Minor variation within a grade is not on its own grounds for return, because grading carries inherent subjectivity. Nothing here limits rights you have under law that cannot be waived.

Changes

We may update this Standard; the posted version is the one in effect, and material changes carry a new date.

Refund & Return Policy

Last updated June 2026

Our Standard

Every card leaves our hands in the condition listed. We grade conservatively — if we're unsure between two grades, we list the lower one. We want you to be genuinely happy with what you receive.

Singles (Individual Cards)

If a card arrives in significantly worse condition than listed, or if you received the wrong card, contact us within 7 days of delivery at hello@harlequinsmarket.com. We'll make it right — either a full refund or a replacement if we have one in stock.

Minor condition variations within a grade (e.g., a light scratch on the back of an NM card) are not grounds for return. Grading has an inherent subjectivity; our listings reflect our honest assessment. Because card condition can change once a card leaves our care, we are not able to accept change-of-mind ("buyer's remorse") returns on singles.

Authenticity

If a card you bought from us is shown to be counterfeit, we refund it in full including shipping and we cover the return — with no time limit, and regardless of the windows below. See the Authenticity section of our Terms of Service.

Sealed Product

Sealed product sales are final once shipped, as we cannot verify the condition of seals after delivery. If your package arrives visibly damaged in transit, photograph it before opening and contact us within 48 hours of delivery. We'll file a shipping claim on your behalf.

Merchandise (Print-on-Demand)

Apparel and accessories are printed to order by our production partner, so we cannot accept returns for change of mind or wrong size — please check the size guide before ordering. If an item arrives misprinted, damaged, or defective, contact us within 14 days of delivery with photos and we will arrange a free replacement or a full refund. Merchandise is produced separately from cards and may arrive on a different day.

Prebuilt Decks & Bundles

A prebuilt deck or bundle is sold as a single product. If it arrives incomplete, or a card in it is significantly worse than the listed condition, contact us within 7 days of delivery and we will make it right. We cannot accept a partial return of individual cards out of a deck.

Shipping Damage

We pack every order carefully. If your order is damaged in transit, keep all original packaging and contact us within 48 hours with photos. We'll work with the carrier to resolve it.

Shipping Methods & Untracked Orders

At checkout you may choose between Standard (no tracking) and Tracked shipping, where available. Standard shipping is sent as a plain stamped envelope with no tracking number and no proof of delivery, which is why it is offered only on lower-value orders.

Standard shipping carries no tracking number, so neither of us can prove where a package got to. We still stand behind it: if a Standard order does not arrive, contact us and we will refund or replace it. Because we carry that risk, Standard is offered only on lower-value orders, and we may require Tracked shipping on an account with repeated loss claims. Tracked orders showing as delivered by the carrier are considered delivered.

Order Cancellation

If you need to cancel an order, contact us as soon as possible. We can cancel and fully refund any order that has not yet shipped. Once an order is in transit it falls under the return terms above.

Returns & Who Pays Shipping

When a return is due to our error — a misgrade, the wrong card, or shipping damage — we cover return shipping and provide a prepaid label. Please return the item in the same condition and packaging in which it arrived; the refund or replacement is processed once we receive it (or, for damage claims, once the carrier claim is filed).

All returns should be approved by us first so we can issue a label and track it. Items sent back without prior contact may be delayed.

Refund Process

Approved refunds are returned to your original payment method within 5–10 business days depending on your card issuer. We do not charge restocking fees. Any member reward issued for a refunded order may be reversed along with the refund. Nothing in this policy limits rights you have under law that cannot be waived.

Privacy Policy

What We Collect

When you create an account: your name and email address. When you place an order: your shipping name and address. If you sign in with a wallet: your public Ethereum wallet address. We do not collect payment card details — those are handled directly by Stripe.

Information We Collect Automatically

When you visit the site, our servers automatically record standard log information sent by your browser, such as your IP address, browser type and version, the pages you view, and the date and time of your visit. We use this strictly to operate and protect the site — for example, to keep you signed in, prevent fraud and abuse, apply rate limits, and diagnose technical problems. We do not build advertising profiles from it.

How We Use It

We use your information to fulfill orders, send order confirmations and shipping updates, and respond to support requests. We do not use your information for advertising or sell it to third parties.

Third-Party Services

Stripe — payment processing. Your card details go directly to Stripe and are never stored by us. Stripe is PCI-DSS compliant.

Shippo — shipping labels and tracking. Your shipping name and address are shared to generate a label and track delivery.

Resend — transactional email. Your email address is passed to Resend solely to deliver order-related emails.

Printful — print-on-demand production. If you order merchandise, your shipping name and address are passed to Printful so they can produce and ship that item to you.

Sentry — error monitoring. When something breaks, technical diagnostic data is sent to Sentry, which can include your IP address and the page you were on. It is used only to find and fix faults.

Backblaze B2 — encrypted offsite backup. Our database backups, which contain order records, are encrypted before they leave our server and stored with Backblaze.

Free Market Protocol — decentralized identity and record layer. If you create an Auth-Key account, your wallet address is recorded on the protocol. When an order is recorded, what is written on-chain is limited to wallet addresses, the amount and currency, an order reference, and a cryptographic hash of the order — a one-way fingerprint. Your name, email address, and shipping address are never written on-chain, and a guest order records no buyer identity at all. On-chain records are inherently public and permanent by design.

Data Security

Card payments are handled entirely by Stripe and never touch our servers. If you sign in with email, we generate a custodial wallet for you whose private key is encrypted at rest with AES-256. We restrict access to personal data to what is needed to operate the store. No system is perfectly secure, but we take reasonable measures to protect your information.

Data Retention

We keep order and payment records for seven years to meet tax and accounting obligations. Account details are kept while your account is open, and web/security logs for about 90 days. You may request deletion of your account data at any time by emailing us; we will delete what we are not legally required to keep. On-chain records cannot be deleted by their nature — see the Free Market Protocol note above for the narrow set of data that reaches them.

Cookies

We use a session cookie to keep you signed in and to maintain your shopping cart. We do not use tracking or advertising cookies.

Children's Privacy

This site is intended for adults. We do not knowingly collect personal information from children under 13. If you are between 13 and 18, you may use the site only with the involvement of a parent or guardian. If we learn that we have collected information from a child under 13, we will delete it. Parents who believe their child has provided us information may contact us at the address below.

Your Privacy Rights

Member rewards. Our rewards programme is tied to your account and your purchase history, so taking part means we associate orders with you in order to work out what you have earned. Rewards have no cash value and you are free not to take part; declining does not change the price you pay or the service you receive.

You may request a copy of the personal data we hold about you, or ask us to correct or delete it, by contacting us at the address below. We'll respond within 30 days.

California residents (CCPA/CPRA) — you have the right to know what personal information we collect, to request a copy of it, to request its deletion, to correct it, and to not be discriminated against for exercising these rights. We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We honour a Global Privacy Control signal where your browser sends one. To make a request, email us and we will verify and respond as required by law.

Changes to This Policy

We may update this policy from time to time. The current version will always be posted at this URL with the date above. Continued use of the site after changes constitutes acceptance.

Prohibited Items & IP Policy

In effect July 2026

Authenticity

Everything we sell is genuine Wizards of the Coast product. We do not sell counterfeit, bootleg, or unauthorized reproductions; we do not sell proxies or test prints; we do not sell trimmed, restored, recolored, or repaired cards as genuine; and we do not sell resealed product.

If a card you bought from us is shown to be counterfeit, we refund it in full including shipping and we cover the return, with no time limit. This is also stated in our Terms.

What We Will Not List

Counterfeit, pirated, or infringing goods. Stolen property, or anything we do not lawfully own and have the right to sell. Anything whose sale is illegal under federal, Kentucky, or local law. Recalled, hazardous, or regulated goods. Cards or product with undisclosed alteration, damage, or resealing.

Our catalogue is limited to trading cards, sealed product, related accessories, and our own branded merchandise. We do not deal in anything outside that scope.

Intellectual Property

Magic: The Gathering, its card names, mana symbols, and imagery are the property of Wizards of the Coast LLC. We are an independent reseller and are not affiliated with, endorsed, sponsored, or approved by Wizards of the Coast. We name games, sets, and cards only as far as is necessary to identify the genuine products we sell, and we do not imply sponsorship or endorsement by any rights holder.

Card data and imagery are used courtesy of Scryfall.

Reporting Infringement

If you hold rights you believe are infringed by something on this site, write to hello@harlequinsmarket.com with: your signature (electronic is fine); identification of the work or mark; the URL of the listing or page at issue; your contact details; a statement of good-faith belief that the use is not authorised; and a statement, under penalty of perjury, that your information is accurate and you are authorised to act for the owner.

We act on valid notices promptly — normally removing or disabling the material while we look into it. Claims of trademark infringement or right of publicity go to the same address; those are governed by different law than copyright, and we handle them case by case.

Counter-Notice

If we removed something of yours by mistake, write to the same address identifying the material and where it was, with a statement under penalty of perjury of your good-faith belief that it was removed in error. We may restore it as the law permits.

Reporting Anything Else

Suspected counterfeits, prohibited items, or anything that looks wrong: hello@harlequinsmarket.com. We investigate good-faith reports.

Changes

We may update this Policy; the posted version governs, and material changes carry a new date.
